  • - None. All manufacturers and importers are obligated to recycle, irrespective of the scale of their manufacturing or import business.
Packaging materials
  • An individual who has manufactured or imported a packaging material subject to mandatory recycling as product packaging
  • - A packaging material manufacturer is generally required to pay waste charges but may also be assigned the obligation to recycle depending on the circumstances
  • Exemption criteria
  • - An individual who does not fall under the category of “producers obligated to recycle packaging materials (Attached Table 4 of the Enforcement Decree)

Types and Sizes of Businesses Obligated to Recycle Packaging Materials

- The obligation to recycle packaging materials is determined based on the total amount of packaging materials released and/or imported according to the material in the previous year, according to the Operating Guidelines on Fulfillment of Recycling Obligations (MOE Established Rule No. 444). In the case of a company that manufactures and imports packaging materials, the mandatory amount is calculated by adding the amount released and imported, if it exceeds the limit set in relation to the sales, released quantity, value of imported goods, and imported quantity.

- Annual sales: The total sales generated by the company obligated to recycle in the year concerned that includes not only the sales of the items subject to mandatory recycling but total sales of the business of the corporate body (sales reported under the business registration number in the case of self-employed individuals)

- Annual value of imported goods: The total value of goods imported by the company obligated to recycle that is calculated based on the cost, insurance, and freight (CIF) and includes all other products and packaging materials that were imported, in addition to the items subject to mandatory recycling
※ In the case of packaging materials, all businesses are obligated to recycle, but businesses that do not meet the prescribed limits, shown above, are exempted from the obligation to recycle. Even so, they still have to add separate disposal labels to the packaging materials.

- In the case of original equipment manufacturers (OEMs), it is the owners of the brand’s trademark who is the “producer obligated to recycle” and the recycling obligation is not additionally assigned to the user, seller, or manufacturer for the same packaging material.
