Grade Assessment

Article 1 (Purpose)

The purpose of this Notice is to set forth the criteria for assessing the material and structure of packaging materials and the ease of recycling the said packaging materials that producers obligated to recycle, under Article 16 (1) of the 「Act on the Promotion of Saving and Recycling of Resources (hereinafter referred to as the “Act”)」 must comply with, in accordance with Article 9-3 of the Act.

Article 2 (Scope of Application)

This Notice shall apply to the packaging materials subject to mandatory recycling under Article 18 of the 「Enforcement Decree of the Act on the Promotion of Saving and Recycling of Resources (hereinafter referred to as the “Enforcement Decree”)」.

Article 3 (Criteria and Grade)

The criteria for grading materials and structures shall be in accordance with the Criteria of Assessing Packaging Materials and Structures and Their Ease of Recycling, and the grades shall be categorized into “Excellent recyclability,” “Good recyclability,” “Average recyclability,” or “Poor recyclability.”

Article 4 (Judgment Method)

The method of judging packaging materials and structures and their ease of recycling is shown in attached Table 2.

Article 5 (Detailed Matters of Operation)

The Minister of Environment may set forth and implement separate guidelines regarding the detailed matters of operation that are not prescribed in this Notice.

Article 6 (Operating Institution)

The tasks related to evaluating packaging materials and structures pursuant to Article 9-3 shall be performed by the Korea Environment Corporation.

Article 7 (Re-Examination Period)

The date by which the changes in the statutes or circumstances, etc. occurring after the issuance of this Notice shall be reviewed and the necessary measures such as abolition, amendment, etc. of this Notice shall be taken, in accordance with the 「Regulations on the Issuance and Management of Directive, Established Rules, etc. (Presidential Directive No. 394)」 shall be December 31, 2022.

ADDENDUM

Article 1 (Enforcement Date) This Notice shall enter into force on the date of its promulgation.
